Community Guidelines

This Community Guidelines is effective as of the date on which the User expressly or impliedly accepts the terms herein, whether by accessing, registering on, browsing, or otherwise using the platform in any manner whatsoever. Alyke is a platform owned, managed, and operated by XVISION IT Private Limited, a company duly incorporated under the provisions of the Companies Act, 2013, bearing CIN No. U72900DL2022PTC398479, having its office at IHDP, Business Park- Studio, 9,10, Sector 127, Noida, Uttar Pradesh – 201304.
For the purposes of these Guidelines, the term “Company,” “We,” “Us,” or “Our” shall refer to XVISION IT Private Limited, including its successors-in-interest, assigns, affiliates, holding companies, subsidiaries, and permitted assigns. The term “User” or “You” shall refer to any individual or entity who accesses, registers on, browses, or otherwise makes use of the platform in any capacity. The following Guidelines set forth the rules and obligations that must be strictly adhered to:
1. ACCEPTANCE AND APPLICABILITY OF GUIDELINES
1.1 The User expressly acknowledges, agrees, and undertakes to comply in full with the Community Guidelines (hereinafter referred to as the “Guidelines”), which shall be read in conjunction with and shall form an integral and inseparable part of the Terms of Use and Privacy Policy (collectively referred to as the “Terms”).
1.2 The User’s access to, registration on, and continued use of the platform shall be strictly subject to adherence to the Guidelines, and any deviation, non-compliance, or breach thereof shall constitute a material violation of the Terms, entitling the Company to take any and all remedial actions, including but not limited to the suspension, restriction, or permanent termination of the User’s access to the platform, at its sole and absolute discretion, without any prior notice or liability.
2. PROHIBITED CONDUCT AND CONTENT RESTRICTIONS
2.1 The User is strictly prohibited from engaging in any conduct that is obscene, sexually explicit, vulgar, offensive, or otherwise inappropriate. Alyke is a social networking platform and shall not be used for any dating, sexually suggestive communications, adult-oriented interactions, or any similar activities, whether explicit or implicit. Any contravention of this provision shall constitute a material breach of these Guidelines and shall result in the immediate suspension or permanent termination of the User’s account, at the sole and absolute discretion of the Company, without any prior notice or liability. The Company reserves the right to initiate appropriate legal action against the User for such violations in accordance with applicable laws.
2.2 The User shall not engage in any form of harassment, abuse, or intimidation against any other User, including but not limited to stalking, following, or persistently contacting another User without their consent, bullying, derogatory remarks, defamation, or personal attacks, and threats of physical harm, blackmail, coercion, or any form of intimidation, whether direct or indirect. Harassment through any medium available on the platform, including direct messaging, comments, posts, or any other means, is strictly prohibited. Any violation of this clause shall result in the immediate and permanent termination of the User’s account. Additionally, depending on the severity of the violation, the Company reserves the right to report such incidents to the relevant law enforcement authorities under the applicable laws.
2.3 The User is strictly prohibited from posting, sharing, distributing, or otherwise disseminating any content that promotes, glorifies, incites, or encourages violence, physical harm, or self-harm, advocates, supports, or provides instructions on acts of terrorism, extremism, or illegal activities, or displays, depicts, or glorifies graphic violence, mutilation, or acts of torture. Any User found violating this provision shall face immediate and irreversible suspension of their account, and the Company reserves the right to take appropriate legal action, including reporting such content and the User to the concerned law enforcement agencies under applicable laws.
2.4 The User shall not post, publish, transmit, or share any content that constitutes hate speech or promotes discrimination, hostility, or violence against any individual or group based on race, ethnicity, national origin, religion, caste, beliefs, gender identity, sexual orientation, disability, age, socioeconomic status, or political affiliation. Any content, including text, images, videos, or other media, that incites hatred, promotes discrimination, or threatens the safety of any individual or community shall lead to the immediate termination of the User’s account without notice. Additionally, if deemed necessary, such violations shall be reported to the appropriate law enforcement agencies for further legal action.
2.5 The Company reserves the absolute right to monitor, review, and remove any content that it, at its sole discretion, determines to be in violation of these provisions, without any obligation to provide prior notice or justification to the User.
3. PRIVACY AND DATA PROTECTION
3.1 The User shall not disclose, share, publish, or disseminate any private, confidential, or personally identifiable information, whether their own or that of any other User, including but not limited to financial details, passwords, authentication credentials, identification documents, government-issued IDs, residential addresses, contact details, or any other sensitive personal information. Any unauthorized sharing, intentional or inadvertent, of such information shall constitute a material breach of these Guidelines and shall result in the immediate and irrevocable suspension or termination of the User’s account, at the sole discretion of the Company, without any prior notice. The Company further reserves the right to initiate appropriate legal action against the User, including but not limited to proceedings under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any other applicable laws governing data protection and privacy.
3.2 The User expressly acknowledges that the Company employs industry-standard security protocols, encryption mechanisms, and data protection measures to safeguard User information. Any attempt to gain unauthorized access, breach security measures, tamper with data protection mechanisms, hack into the platform, intercept communications, or circumvent any security protocols deployed by the Company shall be deemed a grave violation of these Guidelines. Any such conduct shall lead to the immediate and permanent termination of the User’s account, without prejudice to the Company’s right to seek appropriate legal recourse under the Information Technology Act, 2000, and any other applicable cyber laws.
3.3 The Company shall not be liable for any unauthorized disclosure of personal or confidential information by any User, and the User shall bear sole responsibility for ensuring the security of their own data. It is the User’s obligation to exercise caution while sharing information on the platform and to adhere strictly to the privacy and security guidelines set forth by the Company. Any failure to comply with these provisions shall be dealt with in accordance with applicable laws and enforcement actions deemed appropriate by the Company.
4. IMPERSONATION, FRAUD, AND SPAMMING
4.1 The User is strictly prohibited from engaging in any act of impersonation, fraudulent misrepresentation, or deception on the platform. This includes but is not limited to creating fake accounts, assuming the identity of another person or entity, falsely representing an affiliation with any individual, company, or organization, using forged or misleading credentials, or otherwise engaging in any conduct intended to deceive or mislead other Users. Any such fraudulent activity shall constitute a material breach of these Guidelines and shall result in the immediate and permanent termination of the User’s account, without prior notice. Additionally, depending on the severity of the violation, the Company reserves the absolute right to initiate appropriate legal proceedings, including civil and criminal action, under applicable laws governing fraud, misrepresentation, and identity theft. The Company further reserves the right to report such violations to relevant authorities, including but not limited to law enforcement agencies and cybersecurity regulators, for further investigation and enforcement action.
4.2 The User shall not engage in any form of spamming, including but not limited to sending mass unsolicited messages, automated messaging, excessive posting, bulk invitations, phishing attempts, solicitation of Users for personal or commercial purposes, promoting unauthorized or illegal commercial activities, or distributing advertisements, links, or promotional content without the express authorization of the Company. Any attempt to flood the platform with repetitive, irrelevant, or disruptive content that interferes with the normal use and experience of other Users shall be treated as a violation of these Guidelines. Any such conduct shall result in the immediate suspension or permanent termination of the User’s account, at the sole discretion of the Company, without any obligation to provide prior notice or justification.
4.3 The Company reserves the right to implement automated and manual monitoring mechanisms to detect and prevent impersonation, fraud, and spamming. Any attempt by the User to bypass, disable, or interfere with such protective measures shall be deemed an aggravated violation of these Guidelines and may result in legal action, including but not limited to the imposition of penalties, damages, and criminal liability under applicable laws governing cyber fraud and unauthorized digital activities. The Company further reserves the right to recover any financial or reputational losses incurred due to such misconduct and to take all necessary steps to safeguard the integrity of the platform and its Users.
5. PROHIBITION ON ILLEGAL ACTIVITIES
5.1 The User is strictly prohibited from engaging in, promoting, facilitating, or otherwise being complicit in any illegal activities on the platform. This includes but is not limited to any conduct that violates the laws governing human rights, financial crimes, cybercrimes, and public safety. The Company maintains a zero-tolerance policy against any User who participates in, aids, abets, or attempts to engage in such prohibited activities, and any violation shall result in the immediate and permanent termination of the User’s account, without prior notice. The Company further reserves the right to take appropriate legal action, including reporting such violations to the relevant law enforcement authorities, cooperating in criminal investigations, and initiating civil or criminal proceedings under applicable laws.
5.2 The User shall not, under any circumstances, engage in, promote, or facilitate activities related to prostitution, human trafficking, or any form of non-consensual sexual services. Any attempt to use the platform for soliciting, arranging, or enabling commercial sexual exploitation, whether directly or indirectly, shall be treated as a grave violation of these Guidelines and shall result in the immediate suspension and permanent termination of the User’s account. Additionally, any such conduct shall be reported to the relevant authorities under the Immoral Traffic (Prevention) Act, 1956, and other applicable laws governing human trafficking and sexual exploitation. The Company reserves the right to provide full cooperation with law enforcement agencies by sharing relevant User data and evidence to aid in criminal investigations.
5.3 The Company reserves the right to initiate legal proceedings to recover damages caused by such unlawful actions and to take all necessary measures to prevent further abuse of the platform.
6. INTELLECTUAL PROPERTY RIGHTS
6.1 The User is strictly prohibited from posting, sharing, distributing, or otherwise disseminating any content that infringes upon the intellectual property rights of any third party, including but not limited to copyrights, trademarks, patents, trade secrets, or proprietary information. Any unauthorized use, reproduction, modification, adaptation, publication, distribution, or display of intellectual property belonging to another person or entity, whether in whole or in part, shall be deemed a material violation of these Guidelines. In the event of such infringement, the Company reserves the absolute right to take immediate corrective action, including but not limited to the removal of the infringing content, temporary or permanent suspension of the User’s account, and initiation of legal proceedings under applicable laws. The Company shall not be liable for any unauthorized content posted by the User, and the User shall solely bear any legal consequences arising from such infringement.
6.2 The User acknowledges and agrees that all intellectual property rights in the platform, including but not limited to its trademarks, logos, domain names, software, design elements, text, graphics, and proprietary content, are the exclusive property of the Company or its licensors. The User shall not, without the express written consent of the Company, copy, reproduce, distribute, create derivative works from, reverse-engineer, decompile, or otherwise exploit any intellectual property owned by the Company for commercial or non-commercial purposes. Any unauthorized use of the Company’s intellectual property shall result in immediate termination of access to the platform and may subject the User to civil and criminal liability under applicable intellectual property laws.
6.3 Any complaints, disputes, or claims regarding intellectual property violations shall be addressed in accordance with the provisions of the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws governing intellectual property rights in India. Any individual or entity alleging an infringement of their intellectual property rights may submit a written complaint to the Company, accompanied by sufficient evidence and legal justification for the claim. The Company reserves the right to assess, verify, and take appropriate action based on the merits of the complaint, including the removal of infringing content and the suspension or termination of the User responsible for the violation. In cases where legal proceedings are initiated, the Company shall comply with court orders and cooperate with the appropriate authorities in enforcing intellectual property rights.
7. AGE RESTRICTIONS AND ACCOUNT USAGE
7.1 The use of the platform is strictly restricted to individuals who are at least eighteen (18) years of age. By accessing, registering on, or using the platform in any capacity, the User expressly represents and warrants that they meet this minimum age requirement. The Company reserves the absolute right to verify the age of any User at any time and may request valid government-issued identification or other proof of age as deemed necessary. Any User found to be under the age of eighteen (18) or providing false or misleading age-related information shall have their account immediately and irrevocably terminated without prior notice. Additionally, the Company reserves the right to report such violations to relevant authorities, as necessary, in compliance with applicable child protection laws.
7.2 The User is strictly prohibited from engaging in any conduct or disseminating any content that involves or promotes Child Sexual Abuse and Exploitation (CSAE). CSAE includes but is not limited to any form of content, activity, or behavior that sexually exploits, abuses, or endangers minors, such as grooming a child for sexual exploitation, sextortion, child trafficking for sexual purposes, or any other form of sexual abuse or harm inflicted upon a minor. Any User found to be engaged in or facilitating CSAE shall have their account permanently terminated, and the Company shall immediately report such violations to concerned authorities under the provisions of the Protection of Children from Sexual Offences Act, 2012, the Information Technology Act, 2000, and any other applicable laws.
7.3 The User is strictly prohibited from storing, sharing, transmitting, or otherwise disseminating Child Sexual Abuse Material (CSAM). CSAM refers to any visual depiction, including but not limited to photographs, videos, digital imagery, or any other media that involves a minor engaging in sexually explicit conduct. The possession, distribution, or promotion of CSAM is illegal and constitutes a serious criminal offense. The Company maintains a zero-tolerance policy towards any involvement in CSAM and reserves the right to cooperate fully with law enforcement agencies in investigating, reporting, and prosecuting such violations. Any User found engaging in such activities shall have their account permanently disabled, and legal proceedings shall be initiated under the relevant provisions of the Information Technology Act, 2000, the Bhartiya Nyaya Sanhita,2023 and the Protection of Children from Sexual Offences Act, 2012.
7.4 The User shall not create, register, or maintain multiple accounts on the platform, nor shall they engage in any attempt to bypass or circumvent account restrictions, suspensions, or terminations by creating new accounts, using false credentials, or impersonating another individual. The creation or maintenance of joint accounts, shared accounts, or accounts intended for fraudulent or deceptive use is strictly prohibited. Any violation of this provision shall result in the immediate suspension or permanent termination of all associated accounts, and the Company reserves the right to take legal action against any User found engaging in such misconduct.
8. LEGAL COMPLIANCE AND LIABILITY
8.1 The User shall use the platform strictly in accordance with all applicable laws, regulations, and statutory provisions in force within the jurisdiction of India, including but not limited to the Information Technology Act, 2000, the Bhartiya Nyaya Sanhita, 2023, and any other relevant laws, rules, regulations, or guidelines prescribed by the Government of India, regulatory authorities, or law enforcement agencies. The User expressly agrees that any use of the platform that contravenes the applicable legal framework, including but not limited to the dissemination of unlawful content, engagement in fraudulent or criminal activities, or any other violation of statutory obligations, shall constitute a material breach of these Guidelines and shall attract strict consequences, including but not limited to the immediate suspension or termination of the User’s account without prior notice.
8.2 The Company reserves the absolute and unequivocal right to monitor, investigate, and report any unlawful activity undertaken by the User on the platform to the appropriate law enforcement agencies, government authorities, judicial bodies, or regulatory entities, as required under applicable laws. The User expressly acknowledges and agrees that the Company shall have the right to fully cooperate with such authorities, including but not limited to disclosing User data, logs, communication records, and any other necessary information in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable provisions governing data disclosure and compliance.
8.3 The User further acknowledges that any breach of legal compliance obligations while using the platform shall make them solely and exclusively liable for any civil, criminal, or regulatory consequences arising from such violations. The Company shall not be held liable for any acts or omissions of the User that result in legal consequences, financial liabilities, or reputational harm. The User shall indemnify, defend, and hold harmless the Company, including its directors, officers, employees, affiliates, agents, successors, and assigns, from and against any claims, demands, penalties, damages, costs, expenses (including reasonable legal fees), or liabilities arising from or related to any violation of applicable laws committed by the User.
8.4 The Company expressly disclaims any obligation to actively monitor User conduct but reserves the right to take any necessary action, including content removal, account suspension, permanent termination, or legal proceedings, in cases where the User is found to be in violation of Indian laws while using the platform. The Company shall not be liable for any actions taken in compliance with law enforcement directives, court orders, or government mandates and shall not be obligated to provide any prior notice or explanation to the User in such cases.
9. REPORTING MECHANISM AND ENFORCEMENT
9.1 The User is strongly encouraged to report any violations of these Guidelines, including but not limited to prohibited content, illegal activities, harassment, fraud, impersonation, or any other form of misconduct occurring on the platform. That such reports may be submitted to the Company at the official email address: [Insert Official Email Address]. The Company shall maintain the confidentiality of the reporting User to the extent permissible by law and shall take reasonable steps to investigate complaints in a fair and timely manner.
9.2 The Company reserves the absolute and unfettered right to take any and all appropriate enforcement actions against any User found to be in violation of these Guidelines, including but not limited to:
i. Suspension or Termination of User Accounts: The Company may, at its sole discretion and without prior notice, suspend or permanently terminate the account of any User found to be in breach of these Guidelines.
ii. Removal of Prohibited Content: Any content that violates these Guidelines, including but not limited to illegal, offensive, misleading, defamatory, obscene, or infringing material, shall be subject to immediate removal without prior notice to the User.
iii. Referral to Law Enforcement Authorities: Where a User’s conduct amounts to a violation of applicable laws, the Company shall have the right to report such conduct to the appropriate law enforcement authorities, regulatory bodies, or judicial authorities. The Company may fully cooperate with such authorities, including providing necessary records, logs, or any other relevant information required for legal proceedings.
The Company shall not be obligated to justify or provide explanations regarding enforcement actions taken against any User in the aforementioned cases, and no claims or disputes shall be entertained in this regard. Any decision taken by the Company under this clause shall be final, binding, and non-negotiable.
10. UPDATES TO THESE COMMUNITY GUIDELINES
10.1 The Company reserves the absolute and exclusive right to amend, modify, update, or revise these Guidelines at any time, with or without prior notice to the User. Any such amendments shall take immediate effect upon publication on the platform, and continued use of the platform by the User shall be deemed as acceptance of the revised Guidelines.
10.2 The Company is under no obligation to provide individualized notifications regarding changes to these Guidelines, and it shall be the sole responsibility of the User to review the most recent version periodically. The User acknowledges that failure to review updated Guidelines shall not exempt them from compliance with any new or revised provisions.
10.3 In the event that any modification to these Guidelines materially affects the rights or obligations of the User, the Company may, at its sole discretion, provide a general notification on the platform. However, such notification shall not be construed as a mandatory requirement, and the absence of such notification shall not invalidate the enforceability of the updated Guidelines.
10.4 The User expressly agrees that continued use of the platform following any amendments, revisions, or updates shall constitute their unconditional acceptance of such changes. If the User disagrees with any modifications made to these Guidelines, their sole remedy shall be to discontinue use of the platform and terminate their account.

This includes but is not limited to creating fake accounts, assuming the identity of another person or entity, falsely representing an affiliation with any individual, company, or organization, using forged or misleading credentials, or otherwise engaging in any conduct intended to deceive or mislead other Users. Any such fraudulent activity shall constitute a material breach of these Guidelines and shall result in the immediate and permanent termination of the User’s account, without prior notice. Additionally, depending on the severity of the violation, the Company reserves the absolute right to initiate appropriate legal proceedings, including civil and criminal action, under applicable laws governing fraud, misrepresentation, and identity theft. The Company further reserves the right to report such violations to relevant authorities, including but not limited to law enforcement agencies and cybersecurity regulators, for further investigation and enforcement action.
4.2 The User shall not engage in any form of spamming, including but not limited to sending mass unsolicited messages, automated messaging, excessive posting, bulk invitations, phishing attempts, solicitation of Users for personal or commercial purposes, promoting unauthorized or illegal commercial activities, or distributing advertisements, links, or promotional content without the express authorization of the Company. Any attempt to flood the platform with repetitive, irrelevant, or disruptive content that interferes with the normal use and experience of other Users shall be treated as a violation of these Guidelines. Any such conduct shall result in the immediate suspension or permanent termination of the User’s account, at the sole discretion of the Company, without any obligation to provide prior notice or justification.
4.3 The Company reserves the right to implement automated and manual monitoring mechanisms to detect and prevent impersonation, fraud, and spamming. Any attempt by the User to bypass, disable, or interfere with such protective measures shall be deemed an aggravated violation of these Guidelines and may result in legal action, including but not limited to the imposition of penalties, damages, and criminal liability under applicable laws governing cyber fraud and unauthorized digital activities. The Company further reserves the right to recover any financial or reputational losses incurred due to such misconduct and to take all necessary steps to safeguard the integrity of the platform and its Users.
5. PROHIBITION ON ILLEGAL ACTIVITIES
5.1 The User is strictly prohibited from engaging in, promoting, facilitating, or otherwise being complicit in any illegal activities on the platform. This includes but is not limited to any conduct that violates the laws governing human rights, financial crimes, cybercrimes, and public safety. The Company maintains a zero-tolerance policy against any User who participates in, aids, abets, or attempts to engage in such prohibited activities, and any violation shall result in the immediate and permanent termination of the User’s account, without prior notice. The Company further reserves the right to take appropriate legal action, including reporting such violations to the relevant law enforcement authorities, cooperating in criminal investigations, and initiating civil or criminal proceedings under applicable laws.
5.2 The User shall not, under any circumstances, engage in, promote, or facilitate activities related to prostitution, human trafficking, or any form of non-consensual sexual services. Any attempt to use the platform for soliciting, arranging, or enabling commercial sexual exploitation, whether directly or indirectly, shall be treated as a grave violation of these Guidelines and shall result in the immediate suspension and permanent termination of the User’s account. Additionally, any such conduct shall be reported to the relevant authorities under the Immoral Traffic (Prevention) Act, 1956, and other applicable laws governing human trafficking and sexual exploitation. The Company reserves the right to provide full cooperation with law enforcement agencies by sharing relevant User data and evidence to aid in criminal investigations.
5.3 The Company reserves the right to initiate legal proceedings to recover damages caused by such unlawful actions and to take all necessary measures to prevent further abuse of the platform.
6. INTELLECTUAL PROPERTY RIGHTS
6.1 The User is strictly prohibited from posting, sharing, distributing, or otherwise disseminating any content that infringes upon the intellectual property rights of any third party, including but not limited to copyrights, trademarks, patents, trade secrets, or proprietary information. Any unauthorized use, reproduction, modification, adaptation, publication, distribution, or display of intellectual property belonging to another person or entity, whether in whole or in part, shall be deemed a material violation of these Guidelines. In the event of such infringement, the Company reserves the absolute right to take immediate corrective action, including but not limited to the removal of the infringing content, temporary or permanent suspension of the User’s account, and initiation of legal proceedings under applicable laws. The Company shall not be liable for any unauthorized content posted by the User, and the User shall solely bear any legal consequences arising from such infringement.
6.2 The User acknowledges and agrees that all intellectual property rights in the platform, including but not limited to its trademarks, logos, domain names, software, design elements, text, graphics, and proprietary content, are the exclusive property of the Company or its licensors. The User shall not, without the express written consent of the Company, copy, reproduce, distribute, create derivative works from, reverse-engineer, decompile, or otherwise exploit any intellectual property owned by the Company for commercial or non-commercial purposes. Any unauthorized use of the Company’s intellectual property shall result in immediate termination of access to the platform and may subject the User to civil and criminal liability under applicable intellectual property laws.
6.3 Any complaints, disputes, or claims regarding intellectual property violations shall be addressed in accordance with the provisions of the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws governing intellectual property rights in India. Any individual or entity alleging an infringement of their intellectual property rights may submit a written complaint to the Company, accompanied by sufficient evidence and legal justification for the claim. The Company reserves the right to assess, verify, and take appropriate action based on the merits of the complaint, including the removal of infringing content and the suspension or termination of the User responsible for the violation. In cases where legal proceedings are initiated, the Company shall comply with court orders and cooperate with the appropriate authorities in enforcing intellectual property rights.
7. AGE RESTRICTIONS AND ACCOUNT USAGE
7.1 The use of the platform is strictly restricted to individuals who are at least eighteen (18) years of age. By accessing, registering on, or using the platform in any capacity, the User expressly represents and warrants that they meet this minimum age requirement. The Company reserves the absolute right to verify the age of any User at any time and may request valid government-issued identification or other proof of age as deemed necessary. Any User found to be under the age of eighteen (18) or providing false or misleading age-related information shall have their account immediately and irrevocably terminated without prior notice. Additionally, the Company reserves the right to report such violations to relevant authorities, as necessary, in compliance with applicable child protection laws.
7.2 The User is strictly prohibited from engaging in any conduct or disseminating any content that involves or promotes Child Sexual Abuse and Exploitation (CSAE). CSAE includes but is not limited to any form of content, activity, or behavior that sexually exploits, abuses, or endangers minors, such as grooming a child for sexual exploitation, sextortion, child trafficking for sexual purposes, or any other form of sexual abuse or harm inflicted upon a minor. Any User found to be engaged in or facilitating CSAE shall have their account permanently terminated, and the Company shall immediately report such violations to concerned authorities under the provisions of the Protection of Children from Sexual Offences Act, 2012, the Information Technology Act, 2000, and any other applicable laws.
7.3 The User is strictly prohibited from storing, sharing, transmitting, or otherwise disseminating Child Sexual Abuse Material (CSAM). CSAM refers to any visual depiction, including but not limited to photographs, videos, digital imagery, or any other media that involves a minor engaging in sexually explicit conduct. The possession, distribution, or promotion of CSAM is illegal and constitutes a serious criminal offense. The Company maintains a zero-tolerance policy towards any involvement in CSAM and reserves the right to cooperate fully with law enforcement agencies in investigating, reporting, and prosecuting such violations. Any User found engaging in such activities shall have their account permanently disabled, and legal proceedings shall be initiated under the relevant provisions of the Information Technology Act, 2000, the Bhartiya Nyaya Sanhita,2023 and the Protection of Children from Sexual Offences Act, 2012.
7.4 The User shall not create, register, or maintain multiple accounts on the platform, nor shall they engage in any attempt to bypass or circumvent account restrictions, suspensions, or terminations by creating new accounts, using false credentials, or impersonating another individual. The creation or maintenance of joint accounts, shared accounts, or accounts intended for fraudulent or deceptive use is strictly prohibited. Any violation of this provision shall result in the immediate suspension or permanent termination of all associated accounts, and the Company reserves the right to take legal action against any User found engaging in such misconduct.
8. LEGAL COMPLIANCE AND LIABILITY
8.1 The User shall use the platform strictly in accordance with all applicable laws, regulations, and statutory provisions in force within the jurisdiction of India, including but not limited to the Information Technology Act, 2000, the Bhartiya Nyaya Sanhita, 2023, and any other relevant laws, rules, regulations, or guidelines prescribed by the Government of India, regulatory authorities, or law enforcement agencies. The User expressly agrees that any use of the platform that contravenes the applicable legal framework, including but not limited to the dissemination of unlawful content, engagement in fraudulent or criminal activities, or any other violation of statutory obligations, shall constitute a material breach of these Guidelines and shall attract strict consequences, including but not limited to the immediate suspension or termination of the User’s account without prior notice.
8.2 The Company reserves the absolute and unequivocal right to monitor, investigate, and report any unlawful activity undertaken by the User on the platform to the appropriate law enforcement agencies, government authorities, judicial bodies, or regulatory entities, as required under applicable laws. The User expressly acknowledges and agrees that the Company shall have the right to fully cooperate with such authorities, including but not limited to disclosing User data, logs, communication records, and any other necessary information in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable provisions governing data disclosure and compliance.
8.3 The User further acknowledges that any breach of legal compliance obligations while using the platform shall make them solely and exclusively liable for any civil, criminal, or regulatory consequences arising from such violations. The Company shall not be held liable for any acts or omissions of the User that result in legal consequences, financial liabilities, or reputational harm. The User shall indemnify, defend, and hold harmless the Company, including its directors, officers, employees, affiliates, agents, successors, and assigns, from and against any claims, demands, penalties, damages, costs, expenses (including reasonable legal fees), or liabilities arising from or related to any violation of applicable laws committed by the User.
8.4 The Company expressly disclaims any obligation to actively monitor User conduct but reserves the right to take any necessary action, including content removal, account suspension, permanent termination, or legal proceedings, in cases where the User is found to be in violation of Indian laws while using the platform. The Company shall not be liable for any actions taken in compliance with law enforcement directives, court orders, or government mandates and shall not be obligated to provide any prior notice or explanation to the User in such cases.
9. REPORTING MECHANISM AND ENFORCEMENT
9.1 The User is strongly encouraged to report any violations of these Guidelines, including but not limited to prohibited content, illegal activities, harassment, fraud, impersonation, or any other form of misconduct occurring on the platform. That such reports may be submitted to the Company at the official email address: [Insert Official Email Address]. The Company shall maintain the confidentiality of the reporting User to the extent permissible by law and shall take reasonable steps to investigate complaints in a fair and timely manner.
9.2 The Company reserves the absolute and unfettered right to take any and all appropriate enforcement actions against any User found to be in violation of these Guidelines, including but not limited to:
i. Suspension or Termination of User Accounts: The Company may, at its sole discretion and without prior notice, suspend or permanently terminate the account of any User found to be in breach of these Guidelines.
ii. Removal of Prohibited Content: Any content that violates these Guidelines, including but not limited to illegal, offensive, misleading, defamatory, obscene, or infringing material, shall be subject to immediate removal without prior notice to the User.
iii. Referral to Law Enforcement Authorities: Where a User’s conduct amounts to a violation of applicable laws, the Company shall have the right to report such conduct to the appropriate law enforcement authorities, regulatory bodies, or judicial authorities. The Company may fully cooperate with such authorities, including providing necessary records, logs, or any other relevant information required for legal proceedings.
The Company shall not be obligated to justify or provide explanations regarding enforcement actions taken against any User in the aforementioned cases, and no claims or disputes shall be entertained in this regard. Any decision taken by the Company under this clause shall be final, binding, and non-negotiable.
10. UPDATES TO THESE COMMUNITY GUIDELINES
10.1 The Company reserves the absolute and exclusive right to amend, modify, update, or revise these Guidelines at any time, with or without prior notice to the User. Any such amendments shall take immediate effect upon publication on the platform, and continued use of the platform by the User shall be deemed as acceptance of the revised Guidelines.
10.2 The Company is under no obligation to provide individualized notifications regarding changes to these Guidelines, and it shall be the sole responsibility of the User to review the most recent version periodically. The User acknowledges that failure to review updated Guidelines shall not exempt them from compliance with any new or revised provisions.
10.3 In the event that any modification to these Guidelines materially affects the rights or obligations of the User, the Company may, at its sole discretion, provide a general notification on the platform. However, such notification shall not be construed as a mandatory requirement, and the absence of such notification shall not invalidate the enforceability of the updated Guidelines.
10.4 The User expressly agrees that continued use of the platform following any amendments, revisions, or updates shall constitute their unconditional acceptance of such changes. If the User disagrees with any modifications made to these Guidelines, their sole remedy shall be to discontinue use of the platform and terminate their account.
